About License Suspension & DUI

In our state, if you have been arrested for DUI, the Division of Motor Vehicles (DMV) will commence a civil administrative hearing against you to seek the revocation of your driver's license.  You will have 7 days, from your arrest date, to schedule a DMV hearing to fight the charges and try to avoid the suspension or revocation.  This hearing is basically a trial where the police officer that arrested you will testify against you to try and prove that he or she had reasonable suspicion to stop your vehicle, had probable cause to arrest you for DUI, that any breathalyzer or blood tests administered were done legally, that they were accurately administered, that you were indeed above the legal limit (.08 or higher) and that you were advised of your legal rights when you were arrested.  This is a lot to prove during a short hearing, and if there are any issues in question or that fail to get proven, the action to suspend or revoke your driving privileges will likely be dismissed.

If you or someone you know has recently been arrested for DUI, it is imperative that you seek legal counsel immediately with a competent Boulder DUI attorney.  A seasoned legal representative will be able to quickly help determine how to effectively proceed and guide you through the judicial process of your DMV hearing.

You Could Face More Than the Loss of Your License

If you do not have effective representation, or have no lawyer at all, and the officer that arrested you does a good job convincing the DMV that their testimony is credible, you will not only face license suspension or revocation, but also criminal charges for DUI which can result in devastating DUI penalties such as:

  • Incarceration
  • Hefty fines
  • Probation
  • Community service
  • Court order drug or alcohol addiction treatment/classes
  • Possible vehicle confiscation
  • Increased auto insurance premiums
  • Long-term or permanent loss of your driver's license
  • Permanent negative impacts on your legal record, which can affect your ability to get into some colleges, find and maintain employment and your housing options.
